Premises liability is the legal responsibility of a landowner for incidents a person suffers on his or her property. Each year, thousands of people suffer serious injuries due to unsafe conditions or negligent maintenance on someone else’s property. Injuries can occur on a stairway, sidewalk, or in a number of other dangerous locations, and can result in physical impairment or even disability.

Most states have a statute that provides the duty of care owed to people on the property of a landowner. In Colorado, the Premise Liability Act codifies that the duty of a landowner varies depending on the status of the person on the land. For example, landowners owe the highest duty of care to invitees (those who enter the property for the purpose of conducting business). As it relates to invitees, the landowner must protect against dangers which the landowner knew or should have known about. For licensees (those who enter the property for their own convenience with the landowner’s permission), the landowner owes a duty to use reasonable care to warn of known dangerous conditions. Finally, as it relates to trespassers (those who never received permission to enter the landowner’s property), landowners owe a duty to refrain from willfully or deliberately injuring trespassers.

Injuries sustained in a personal injury can be very difficult to manage. Victims can become frustrated in dealing with injuries, mounting medical bills, and overwhelming physical and emotional distress. Many landowners carry insurance that might include compensation for medical expenses, lost wages, pain and suffering, and disability.
